Natal LLC., a California limited liability company (“Natal” “we,” “us” or “our”) is committed to respecting the privacy rights and concerns of users of our website (the “Service”). As such, we’ve established and implemented this Privacy Policy to inform users of the Service of how we use and protect the information we collect through the Service. Please read through this Privacy Policy carefully. If you provide your personal information to us via the Service; or provide your personal information in communications with us, you consent to our use of your personal information as described in this Policy. This Privacy Policy is effective as of the date set forth above.

HOW DOES NATAL GET MY INFORMATION?
We collect information about you in various ways, including through your communications with us, your interactions with our Services, technologies we use on our website, and through third parties, including social media platforms. Some of these are obvious, like when you provide us your information directly, (i.e. creating an account, making a purchase, communicating with us, or interacting with us on social media). These will always be obvious, and you'll know what you're providing us because you're the one creating an account, shopping with us and sharing your enthusiasm for Natal with us on our site and tagging us on social media.
In addition to those, we also may collect information about you through third parties, specifically through the following:
Third-Party Service Providers: We may collect personal information from third parties that support our business, including analytics providers, marketing partners, vendors who assist with providing the Services, and other third parties that we work with.
Automated Technologies: We and our third party service providers use automated technologies to administer the Service, track users’ movements on our Website and analyze trends. Relatedly, Service may use cookies, tags, pixels and similar technologies ("Cookies") to provide, customize, evaluate, improve and protect the Service. Cookies are text files placed on your browser or device when you visit a website or use an app. This includes our own first-party Cookies and third-party Cookies of our service providers and marketing partners. Cookies serve a variety of functions for you, like enabling us to remember your log-in information when you use our Service. Strictly Necessary. These Cookies are necessary to make the Service run and enable basic functions like page navigation. They also help us identify and control trusted web traffic, as well as detect and prevent fraud or malicious activity. Finally, they ensure the Service responds to your instructions, such as remembering items you have added to your cart.
Performance and Analytics. Cookies help us analyze how you interact with our Sites and Apps to improve user experience and functionality.

PERSONAL INFORMATION WE COLLECT
Personal Information
We do collect certain pieces of personally identifiable information, or "PII." PII means information that can be used to identify and contact you. This includes things like your name, address, email address, phone number, or payment information.
Usage Information.
We collect information about you that you provide to us when you use our service. This may include your name, address, email address, phone number, payment information, as well as information from you through your device (i.e. comments from you, video of your exercise to evaluate your posture). By sending images to us, you consent to our use of those images as we describe the use within the Service. While we do collect information regarding the exercises to evaluate your posture, we do not retain these images beyond the brief posture evaluation.
Purchase Information
Additionally when you make a purchase or attempt to make a purchase through the Service, we collect certain information from you, including your name, billing address, shipping address, payment information (including credit card numbers), email address, and phone number. We refer to this information as "Purchase Information".
Account Information.
To access your purchases, or to access some functions of the Service, we may need to collect certain information from you, like your name, email address, and password for your account with the Service. This is to ensure that you have an account applicable to you through the Service, so you can access those functions, like our message boards, electronic video lectures, or past purchases.
Device Information
When you utilize the Service, we automatically collect certain information about your device, including information about your web browser (when applicable), device type, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you utilize the Service, we collect information about any individual web pages or products that you view from the Service, what website or search terms referred you to the Service, and information about how you interact with the Service. We refer to this automatically-collected information as "Device Information".
We collect Device Information using the following technologies (collectively, "Information Collecting Technologies"):

HOW DO WE USE YOUR PERSONAL INFORMATION?
Providing The Service to You
We use your Personal Information (specifically your Account Information, Usage Information, and Purchase Information) to provide the service to you. This includes:
- Setting up an account
- administering the subscription for the Service
- process and fulfilling any orders, subscriptions, or purchases, communicate with you and provide customer service
- communicate with you if you opted into marketing communications
- process your payments
- verify your identity
- evaluate your performance and provide feedback regarding any physical exercises.
- On any other occasion where we ask you for consent, where we will use the Personal Information we collect as we explain to you at that time.
Processing your Purchase
We use the Purchase Information that we collect generally to fulfill any orders placed through the Service (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Purchase Information to:
- Communicate with you
- Screen our orders for potential risk or fraud; and
- When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.
We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Service (for example, by generating analytics about how our customers browse and interact with the Service, and to assess the success of our marketing and advertising campaigns).
Improving the Service
We may also use Personal Information to communicate with you to do any of the following:
Providing Technical Support: We use your personal information to provide technical support that you may request in using our Service.
Responding to Copyright Disputes: We may also use your Personal Information in response to copyright disputes that you may submit through the DMCA process.
Fine-tuning the Services: We use your comments, feedback and cookie information to better tune the Services to address your needs and desires for information.

DATA RETENTION
When you place an order through the Service, we will maintain your Purchase Information for our records unless and until you ask us to delete this information.
SHARING YOUR PERSONAL INFORMATION
We share your Personal Information with third parties to help us use your Personal Information, as described above. For example, we use Apple and Google to manage subscriptions for our app-based Service.

We will also share the personal information we collect from you under the following circumstances:
Protection of rights. Natal will share personal information if we have a good faith belief that (i) access, use, preservation or disclosure of such information is reasonably necessary to satisfy any applicable law, regulation, legal process, such as a court order or subpoena, or a request by law enforcement or governmental authorities, (ii) such action is necessary to detect, prevent, or otherwise address fraud, security or technical issues associated with the Service, or (iii) such action is appropriate to protect the rights, property or safety of Natal, its employees, clients, or users of the Service.
Asset transfers. If we become involved in a merger, acquisition or other transaction involving the sale of some or all of Natal assets or a line of business, user information, including personal information collected from you through your use of the Service, could be included in the transferred assets. Should such an event occur, Natal will use reasonable means to notify you through a prominent notice on the Service. By sharing your personal information with Natal, you are giving Natal consent to transfer your personal information to a third party in an asset transfer described here.
Service Providers. We may share your personal information with third party vendors or service providers that we engage for the purpose of fulfilling product orders or processing information on our and your behalf. For example, we may partner with other companies to process payments for the Service. Additionally, we may partner with other companies to process, analyze, and/or store data, including, but not limited to, analytical data used to tweak and maximize your experience. While providing services for us, these companies may access your personal information. To the extent applicable, we require these entities to comply with this Privacy Policy and appropriate confidentiality and security measures.
Finally, we may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.
YOUR SECURITY AND RIGHTS
Security Measures
We treat data private information that must be protected against loss and unauthorized access. To safeguard the confidentiality and security of your Personal Information, we may use commercially reasonable practices and technologies including but not limited to firewalls, and SSLs.
However, no server, computer or communications network or system, or data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect user information, we cannot ensure or warrant the security of any information you transmit to us or through the Service and you acknowledge and agree that you provide such information and engage in such transmissions at your own risk.
Choices With Respect To Interest-Based Advertising.
You can manage your preferences regarding interest-based advertising (including opting out) by visiting the Preferences section of your account in the App. Please note that even if you opt out of interest-based advertising, tracking technologies may still collect data for other purposes including analytics and you will still see ads from us, but the ads will not be interest-based ads.
Choices With Respect To Information Collecting Technology.
You may block Information Collecting Technology in your browser or device settings, as and if permitted by such device, but in some circumstances, disabling these features may interfere with your ability to access our products or services.
Managing Your Account.
You may access, modify or delete your account on the settings or profile page contained in your account by clicking on this link or by contacting the Privacy Officer at support@natal.app with such written request. We may ask that you confirm and verify your identity.
Your Rights.
Subject to certain exceptions prescribed by law in the jurisdiction where you reside, you may certain rights: including a right to know or access the information we collect about you and process; a right to delete your information, a right to correct or modify your information; a right to opt out of sale, sharing; a right to opt out of targeted advertising; a right to revoke or withdraw consent; a right to non-discrimination; a right to portability of your data; a right to opt out of profiling for automated decision making, and a right to limit the use and disclosure of sensitive personal information (like payment information). You may make requests regarding the privacy rights available to you, by writing to us at support@natal.app. We may request certain personal information for the purposes of verifying the identity of the individual seeking access to their personal information records, as well as the jurisdiction in which you reside, to determine what protections you have. Please note that if you withdraw your consent to our collection, use or disclosure of your personal information, we may not be able to provide some or all of our services to you. If you believe that applicable data protection laws have not been complied with, you may lodge a complaint with us by using the contact information provided below. You also have the right to complain directly to the appropriate data protection authority
Marketing Communications.
You may opt-out of receiving commercial email and other electronic messages from us (excluding transactional messages) by following the instructions contained in those messages or by changing your preferences in the Preferences section of your account. You can also contact us as set out below.
International Transfers
If you live within the UK or European Economic Area, the personal information that we collect from you may be transferred, stored and processed in the United States or any other country in which Natal or its affiliates, subsidiaries or agents maintain facilities, and by using the Service, you consent to any such transfer of information outside of your country.
ADDITIONAL INFORMATION REGARDING THIRD PARTIES
When you click on a third party logo or URL displayed on our Service that links you to a different website, our Privacy Policy no longer applies and you must read the privacy policy of the third party to see how your personal information will be handled on their website. If you cannot find their privacy policy, then you should contact the respective webmasters of those websites to obtain information regarding their information collection, use and disclosure policies. We are not responsible for their collection and use of your personal information.
CHANGES
We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.
MINORS
The Service is not intended for individuals under the age of 18 years old. We do not knowingly collect any personal information from children under the age of 13 (or such other age as specified under applicable law) without parental consent. If we learn that a child for whom parental consent is required has provided us with personal information, we will use reasonable efforts to delete it in accordance with applicable law. If you are a parent or guardian of a child under the legal age of consent, and you believe your child has provided us with personal information, please contact us by following instructions at the “Contact Us” section below.
YOUR STATE RIGHTS
Consumer Rights Under U.S. State Comprehensive Privacy Law
Depending on applicable state law, you may have the right to object to our collection and use of your personal data at any time, or to access or require us to correct or delete the data that we have collected and retained about you. We will fulfill your request to exercise any of these rights within the applicable time period prescribed by such laws. - Right to Know or Access: You may have the right to obtain confirmation about whether or not your personal information is being processed by us. If so, you may have the right to access the personal information we hold about you (including the specific pieces of personal information) and/or request other related information, such as the purposes for which use that information, the categories of personal information we process about you, the categories of recipients to whom your personal information has been or will be disclosed, the retention period for such personal information, or, if not possible, the criteria used to determine that period, your legal rights with respect to your personal information, etc.
- Right to Delete: You may have the right to request the deletion of your personal information, except under certain circumstances subject to applicable law.
- Right to Correct: Depending on your location and applicable laws, you may have the right to correct or update your personal information if inaccurate.
- Right to Opt-out of Sale, Sharing, and Targeted Advertising of your Personal Information: You may have the right to opt-out of the sale of your personal information to third parties. You may also have the right to opt out of the processing of your personal information for the purposes of targeted advertising.
- Right to Revoke or Withdraw Consent: You may have the right to withdraw consent to the continued use or disclosure of your personal information, subject to legal or contractual restrictions and reasonable notice.

You may also have the right to send that personal information to another controller.
- Right to Opt-out of Profiling: You may have the right not to be subject to a decision based solely on profiling or automated decision-making.
- Right to Limit the Use and Disclosure of Sensitive Personal Information: You may have the right to limit the use and disclosure of your sensitive personal information if we use such information to infer characteristics about you; however, we do not disclose your sensitive personal information except to complete a transaction with you as required by law.
Exercising Your Rights / Verifiable Consumer Request.
To submit such a request, please contact us by email at support@natal.app or by mail at one of the addresses below. Please note that we may continue to share your personal information with our affiliates and service providers, for essential purposes described above and other such circumstances.
Verification.
We cannot respond to your request or provide you with personal information unless we can verify your identity and your authority to make the request and confirm that the personal information relates to you. A verifiable consumer privacy request must:
provide sufficient information that allows us to reasonably verify you are the person about whom we have collected personal information or an authorized representative;
describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
Authorized Agent.
If you are a resident of California you may, under certain circumstances, authorize another individual or a business, called an Authorized Agent, to make requests on your behalf. If you wish to have an Authorized Agent make a verifiable consumer request on your behalf, they will need to provide us with sufficient written proof that you have designated them as your Authorized Agent, and we will still require you to provide sufficient information to allow us to reasonably verify that you are the person about whom we collected personal information.
Responding to Your Request.
It is our goal to respond to your request within 45 days of receiving that request. If we require more time or are unable to comply with your request, we will inform you of the reason and inform you of the extension period for completion in writing. Any disclosures we provide will only cover the 12-month period preceding receipt of the verifiable consumer request. If we cannot comply with part or all of your request, we will explain the reasons in our response.
We do not charge a fee to process or respond to your verifiable consumer privacy request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
Appeals.
Residents of California, Texas, and Virginia have the right to appeal a denial of their request by contacting us as described in our notice of denial.
California "Shine the Light" Law
If a business shares “personal information” (as defined in California’s “Shine the Light” law, Cal. Civ. Code § 1798.83) with third parties for their direct marketing purposes (e.g., to send offers and information that may be of interest to you), California law requires either providing a mechanism by which consumers can obtain more information about such sharing over the prior calendar year, or providing a mechanism by which consumers can opt out of such sharing. We do not share your personal information with third parties for their direct marketing purposes.
Nevada Disclosure
Residents of Nevada have the right to opt out of the sale of certain personal information to third parties. We currently do not sell your personal information as defined by Nevada law.
YOUR EU RESIDENT RIGHTS
As a European Union Resident, you enjoy certain protections under the Global Data Protection Regulation or GDPR. The GDPR is a new piece of legislation applying to users residing within the European Union. In compliance with the GDPR, users who are residents of the European Union may request:
Access copies of any personal data concerning you, as a user of the service, to be received by you within one month.
Corrections of inaccurate data concerning you as a user of the service.
Deletion of your data if any of the following apply:
You believe we no longer need your information.
You've withdrawn consent to process your data.
You've objected to automatic processing.
You believe processing of your data is unlawful.
You have a right under your country's law to have data erased.
You were a user of the services when you were 16 years old or younger.
Your personal data for your possession or re-use for your own purposes.
An objection to processing of personal data for direct marketing purposes with grounds on why the user believes the processing would be unlawful.
Limitations in the way we use your personal data if any of the following apply:
Personal data that was provided to us is incorrect
You believe the processing is unlawful and you do not wish to delete your data
You believe Natal no longer needs the data
You have objected to processing.
Rejecting decisions based only on automated processing that produce legal effects concerning them.
The rights above may be subject to certain conditions, such as–but not limited to–Natal needs to comply with enforcement of civil law claims; prevention, detection, or prosecution of criminal offenses; or the rights of others. Mediation
If you are a resident of a country outside the European Union, you agree that, in the Natal any dispute or claim arises out of or relating to this Privacy Policy, you and Natal will attempt in good faith to negotiate a written resolution of the matter directly between the parties. You agree that if the matter remains unresolved for forty-five (45) days after notification (via certified mail or personal delivery) that a dispute exists, all parties shall join in mediation services in Dallas, Texas, with a mutually agreed mediator in an attempt to resolve the dispute. Should you file any arbitration claims, or any administrative or legal actions without first having attempted to resolve the matter by mediation, then you agree that you will not be entitled to recover attorneys’ fees, even if you would otherwise be entitled to them.
EU Dispute Resolution
While we hope that if you're in the EU you enjoy our Service, if you have inquiries or complaints please contact us first at support@natal.app with "EU PRIVACY" in the subject line. We will respond within 45 days. In compliance with the EU-US Privacy Shield Principles, Natal is committed to resolving complaints about our collection or use of your personal information.
CANADIAN PRIVACY RIGHTS
If you are located in Canada, you have the right to access and correct your personal information subject to certain required and permitted exceptions under applicable law. You may also have the right to:
- be informed of the existence, use, and disclosure of your personal information, and challenge the accuracy and completeness of it;
- receive an account of the use that has been made or is being made of your personal information, including information about the purposes for which your information has been and is being used by Natal;
- receive an account of the third parties to whom your personal information has been disclosed, including a list of organizations/persons to which Natal disclosed or may have disclosed your information, and information regarding the circumstances in which your information has been and is being disclosed to such persons;
- Ask questions about Natal's collection of your personal information or Natal's service providers outside Canada, and obtain written information regarding Natal's policies and practices with respect to service providers outside Canada; and/or
- Address a challenge concerning Natal's compliance with applicable laws to our Privacy Office / General Counsel.
Natal will respond to requests by individuals in Canada to exercise their rights in accordance with the relevant law(s). Nothing herein is intended to create any rights that do not exist under the applicable law in the jurisdiction where you are located.
GOVERNING LAW
This Privacy Policy is governed by, and construed under, the laws of the United States of America and the laws of the State of Texas, excluding its choice of law provisions.
